Our Friends of PK program (the “Program”) is meant to encourage you to bring new people into Parrot Kindergarten. It does not create any relationship between us; you are not our employee, nor do we have a partnership: by participating, you are agreeing to being an an independent contractor. You may not present yourself as a part of Parrot Kindergarten (other than as a member) and may not create any obligation on behalf of Parrot Kindergarten.

By participating in the the Program, you indicate your acceptance of this Agreement and its terms and conditions.

Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

We reserve the right to terminate your participation in the Program, at any time, by providing you with notice of such termination. Should we terminate our agreement, you must cease using all of our Intellectual Property Rights.

Credits To Your Account

Anyone who uses your Friends of PK program link and then enrolls in either the LITE or FULL membership for a minimum of two consecutive months, after their second payment, YOU will be credited a free month of PK on your account. Your free month is the same as your current plan (LITE or FULL). If you are not currently a member, the free month is LITE.

Additionally, if they sign up for an annual membership, you will be credited a free 1 hr private session with a PK counselor as well.

Eg. Three new people sign up through your link and remain in Parrot Kindergarten for a minimum of two months each, you are credited three free months on your PK membership.

Your account will be credited once their first two months have passed.

You cannot refer yourself, and you will not receive a free month from purchases on your own accounts.

Notes:

It is possible for people to receive multiple Friends of PK Program links (from different members).  The LAST link clicked before a purchase is made will determine who receives the credited free month.

Your Friends of PK Program link is saved as a cookie on your friends computer/phone. It the friend clears cookies, that would be lost and no credit would apply to your account.

Cookies last for six months, i.e, if someone signs up less than six months after your link was used, you will received the credit (unless they have cleared cookies or clicked someone else’s Friend of PK Program link).

The use of your link (or QR code) is the ONLY way for you to receive credit. Verbal referrals are great but you will not be credited free months for anyone enrolling unless they use your link. 

Terms

You may produce promotional materials, emails, flyers, etc however if we find that your promotional material is problematic, offensive, illegal or otherwise objectionable, we may terminate your participation in the program.

Please respect our intellectual property. We reserve all our Intellectual Property Rights. We provide anyone participating in the Program a limited, temporary, non-exclusive, non-transferrable, non-sublicensable license to use our brand names, Parrot Kindergarten and such license is limited only to the use in promoting our products and services. This means that you cannot use our Intellectual Property Rights with another brand name or as a bundled project. Our logo is not part of this agreement and may not be used by your promotion. It also means that you cannot allow others to use the content we licensed to you.

You cannot provide any copy of Parrot Kindergarten materials nor content, nor can you create derivative works of it. This is to ensure that all distribution of Parrot Kindergarten is made only via our official channels and without any modifications.

We consider the following as “bad practices” which are prohibited and will cause automatic termination of your participation in this Program,

Please note that if at any time we believe that you acted in bad faith or illegally, we may also cancel your participation in the Program without notice.

The following are considered bad practices:

using deceptive practices, encouraging users to click banners or use of any automated means to create traffic

presenting yourself as a part of Parrot Kindergarten

using the Parrot Kindergarten brand as a part of your domain name, website name, banners or in any form of paid advertising (for example, PPC campaigns)

using domain names that imply any link to the Parrot Kindergarten brand including the word “Parrot Kindergarten ” or similar sounding, looking or typed names

spamming (sending unsolicited emails, text, voice calls, etc)

using paid search or keyword advertising using our Intellectual Property Rights or brand name to drive traffic to your site or to the banners

offering coupons or discounts without our consent

allow others to use your login access to Parrot Kindergarten

using words like “deal”, “sale” or “discount” in a deceptive manner or in a way stating that there is any discount, rebate, cash-back or other reduced payment for the services when there isn’t

This list is non-exhaustive, and we may block any practice that we believe is bad and terminate or suspend your participation in the Program.

Bad Practices also include any illegal or unauthorized advertising, infringing intellectual property rights, invading users’ privacy, or otherwise using any advertising in violation of local laws and regulations.

You shall at no time contest, challenge, encourage or aid third-parties in contesting the validity or ownership of any Parrot Kindergarten Trademarks or Patents, or take any action in derogation of our rights therein, including, without limitation, applying to register any trademark, tradename patents, or other designation that is confusingly similar in any way to the Parrot Kindergarten Trademarks.
We do not allow the use of the Parrot Kindergarten Trademarks in advertising, including Google Ads and other search engines.

As an independent contractor, you shall bear all taxes and expenses relating to the crediting of free months or sessions.

We reserve the right to change these Guidelines at any time, at our sole discretion, with immediate effect.

Indemnification

Any participant in the Program shall indemnify and hold harmless Parrot Kindergarten and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Parrot Kindergarten to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by participating in the Program. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
